Types of Intellectual Property Licenses
The general provisions for an intellectual property license are outlined in Licensing Agreements above. However, some provisions are particular to the type of intellectual property being licensed.
- Patent licenses - particular provisions may include,
- Country - If the original patent application carries information (and dates, numbers, etc) regarding the countries for which patents are held, this should be included in the license agreement. A statement as to which of the parties is responsible for complying with the formalities of these protections should also be made.
- Exclusivity - There should be a provision that states whether the license
is either exclusive (guarantees no other competition, even from the licensor),
or sole (guarantees that the licensor will permit no other licenses within
that territory), or simple (No guarantees, but simply gives authority to use
